Terms and Conditions
Effective: January 01, 2021
By registering, accessing or using SWEEP services, you confirm that you are to be bound to these terms.Â For whatever reason that you do not agree to these Terms, you may not access or participate in SWEEP.
SWEEP has the right to terminate and cease any relationship with you at any time and for any reason.
By agreeing to the Terms, you warrant that: (a) you are at least 18 years old and can make and enter into binding contracts.
While participating in our services, you acknowledge the following:
SWEEP, Inc. connects Cleaning Professionals and clients together.Â Neither are employees of SWEEP.
All Users may use SWEEP, Inc. if they follow the Terms and Use. Â
You agree to not schedule or pay for cleaning services outside of SWEEP from Users brought together by SWEEP.
SWEEP reserves the right to store freely given information to provide a better service, monitor breaches in this Agreement and prevent fraud.
SWEEP will not be held responsible for any damages that may occur to any appliances or objects that are used at the client's request. Â Ex: washers, dryers, vacuum cleaners, clothes etc or any items or equipment that are not securely fashioned or placed in positions that are likely to cause damage or become damaged. Any form of apparel washed, ironed or folded will be done at the client's risk.
A customer will be held liable for the full cost of a cleaning if they misrepresent the condition of their home or business whether the cleaning is completed or not. Misrepresentations include but are not limited to: feces, blood and other bodily fluids are present, water or electricity are turned off or homes are not within normal conditions (biohazards, pest infestations, hoarding etc.)
We love pets and understand that they are essential members of your family. In order for our cleaning professional to do a thorough job, guarantee our work, and avoid any anxiety or protective behavior of your pet, we gently request to control them during the duration of the cleaning.
Move in/ Move out cleanings
SWEEP offers a move-out or move-in all included price based on the size of your home. We base this price on what is discussed and the size of your home. SWEEP reserves the right to change the price upon entry to your home if the price that is agreed upon does not match up with the work that is needed to complete your cleaning.
Homes/apartments must be empty and have electricity and running water available at the time of the appointment for us to service them. Failure to provide these utilities will result in SWEEP canceling the appointment and charging you the full amount of the appointment.
If the requested cleaner is unavailable SWEEP will inform the customer and will ask for permission to send a different cleaner who is currently available or reschedule the requested cleaning to a date that the requested cleaner is available. Our cancellation/ No show policy applies to all appointment types, please review our cancellation/no-show fees policy for more information.
In the event that the home/apartment is not completely empty, Sweep will clean around boxes/furniture to the best of our availability. Our SWEEP guarantee won't apply to units that are not completely emptied by the start of the scheduled appointment or of there are individuals entering and exiting the unit during the appointment.
Cancellation/ No show/ Reschedule Fees
Customers: All cancellations can be processed through communications with SWEEP. .Â If cancellations are submitted 72 hours or more before a scheduled cleaning, there will be no charge.Â If cancellations are submitted within 72 hours of a scheduled cleaning the entire service amount will be charged. If the appointment is not cancelled or rescheduled and the professional cleaner shows up for a cleaning and the customer does not show, the entire amount of the scheduled cleaning will be charged. SWEEP also reserves the right to charge for the entirety of the scheduled cleaning if the customer fails to reschedule within 72 hrs of a scheduled cleaning. In some instances, rescheduling may not be possible. If the customer reschedules the appointment day of the appointment they will be charged the full cost of the scheduled appointment.
Lock Out / No show Fees
Customers: All cancellations can be processed through communications with SWEEP. In the event that our cleaners are unable to gain entry to your home within 30 minutes upon arrival, SWEEP reserves the right to cancel your appointment and charge the full amount of your scheduled appointment. If the customer opts into having the SWEEP Cleaner wait for the customer to arrive at the home, SWEEP reserves the right to bill the customer for the time that was spent waiting for the customer to arrive.
We Do Not Provide
Clean/ Shampoo upholstery or carpet
Move heavy furniture, appliances, rugs, or anything over 20 lbs
Littler box cleaning
Service outdoor areas
Clean exterior of windows
Clean tracks of windows or sliding doors
Remove rust, paint, or mold
Wipe clean window blinds or shades
Provide stain removal
Clean homes not in standard conditions (biohazards, pest infestation, hoarding, no power, no water, etc.)
Wipe clean lightbulbs due to high risk of breakage
Clean or remove any feces (human or animal) and/or blood or any other bodily fluids
Climb higher than a two-step ladder
Remove or haul away the trash, debris, or furniture
Service homes without a comfortable temperature to work with: air conditioning in the summer, heating during winter
Service homes without electricity and/or running water
Wash floors by hand
Clean TV and computer screens
In the event of severe weather, Sweep reserves the right to reschedule your appointment to a different date and time of your choosing. In the event of inclement weather a surcharge of $25 will be added to the cleaning in order to help our cleaners with transportation and parking costs while traveling in harsh conditions.The weather will be evaluated the morning of your cleaning and you will be notified via a text message if this surcharge will be added to the cleaning. At that time, you may reschedule the appointment at no cost.
SWEEP guarantees our professional contractors work, if the cleaning is not to your satisfaction or if you feel like we missed things, reach out within 24 hours and we will send the cleaners back to fix things. SWEEP will review the quality issues based on both the details of your booking, how many hours were given to us to complete your requested cleaning and photos provided. If the client does not reach out within 24 hours we can no longer guarantee our cleaning and a follow up appointment would need to be booked and paid for.
You and SWEEP agree that in any dispute arising from these Terms will be settled by binding arbitration and not in a court of law.Â You and SWEEP are each waiving the right to a trial or to participate in any class action.Â Unless You and SWEEP are both in agreement, all disputes will be handled through binding arbitration on an individual basis.Â Any AAA filing, administrative or arbitrator fees are your responsibility to pay.
Services. SWEEP creates a marketplace where cleaning providers and cleaning service customers can locate each other to agree on a cleaning service to be provided.Â All cleaning service providers are independent or self-employed.Â SWEEP will facilitate the meeting of the providers and customers through digital marketing.Â SWEEP also will provide easy payment processing solutions. Â SWEEP will also offer insurance that can be purchased to protect providers and give customer reassurance.
Customers will be given options on who they may hire.Â Options will be based on distance to the job location and not based on gender, appearance or race.Â Customers may search for a specific cleaning professional by searching for their name in the APP or by requesting them directly through our online booking process. If the requested cleaner is unavailable SWEEP will inform the customer and will ask for permission to send a different cleaner who is currently available or reschedule the requested cleaning to a date that the requested cleaner is available.
(viii) remove, replace , or correct all or any portion of the work or end products found defective or unsuitable, without additional cost or risk to the company.
(ii) The contractor has the sole right to control and direct the means, details, manner, and method by which the services will be performed, and the right to perform the services at any time, place or location. The contractor or the contractor’s staff shall perform the services within the designated or agreed upon time, and the company is not required to hire, supervise, or pay any assistants to help the contractor pervorm those services. The contractor shall provide insurance coverage for itself and its staff.
SWEEP may offer promotions or coupon codes to generate more jobs for the Providers. All promotions and coupons will not affect compensation agreements that the Provider has with SWEEP. Users using SWEEP, will have User provided content when constructing their profiles, including uploading photos. You agree not to provide user content that is hateful, violent, obscene, pornographic, defamatory, unlawful or offensive.Â All user content will be may be reviewed, monitored or removed by SWEEP at SWEEPâ€™s own discretion without any notice to you.Â Inappropriate user content will permanently ban the user from participating in SWEEPâ€™s services in the future.
All Providers using SWEEP will be required to go through a background check.Â All background checks will be performed by a third- party and will include National Criminal Data Base search including Sex offenders.Â Each Provider will have to provide a government-issued identification card and submit a photo on their profile.Â All Providers accept these terms for their use of SWEEP.Â SWEEP cannot assume responsibility for the reliability of the background check, although each provider will be checked on.You agree that SWEEP will not be held responsible or liable for any damage that might happen through using SWEEP.Â SWEEP will not be liable or held responsible for the conduct of these Providers including and injury or damage that may arise due to the relationship created through SWEEP.Â Each User should exercise caution to protect themselves and property.
LIMITATION OF LIABILITY
SWEEP SHALL NOT BE LIABLE FOR INCIDENTAL, INDIRECT, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES.Â THESE INCLUDE PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO THE SERVICES RENDERED BY PROVIDERS FOUND ON SWEEP REGARDLESS OF THE NEGLIGENCE OF SWEEP, EVEN IF SWEEP HAS BEEN NOTIFIED OF POSSIBLE SUCH DAMAGES.Â SWEEP SHALL NOT BE LIABLE FOR ANY DAMAGES.Â FOR ANY DISPUTES REGARDING A SERVICE RENDERED, THAT WILL BE BETWEEN THE CUSTOMER AND THE PROVIDER, NOT SWEEP.
SWEEP DOES NOT GUARANTEE THE RELIABILITY, QUALITY, PROMPTNESS OF THE SERVICES PROVIDED.Â SWEEP WILL DO ITâ€™S BEST TO ADVISE QUALITY AND PROMPTNESS OF THE PROVIDERS, BUT SWEEP CANNOT BE HELD LIABLE FOR IT.Â YOU AGREE TO THE ENTIRE RISK THAT MAY COME FROM YOUR USE OF THESE SERVICES TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.
You agree to indemnify and hold SWEEP and its affiliates and their officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees), arising out of or in connection with: (a) your use of SWEEP; (b) your breach or violation of any of these Terms; (c) SWEEP's use of your User Content.
You agree to not recreating, altering or changing SWEEP in any way. You may not publish, take images, coding or steal any proprietary properties of SWEEP. User's have no ownership of SWEEP and only are allowed access to it as long as they abide by the terms and conditions set.
Any failure to enforce these Terms does not constitute a right or provision to the terms
Communication with You.
We reserve the right to send messages to you to (a) inform you of changes or additions to the Site, the Products, this Agreement or the Fee Schedule (defined below), (b) to inform you of violations of this Agreement or actions relating to your privilege to access and use the Site or the Products, (c) to inform you of any other matter related to the Site, the Products or this Agreement or (d) for marketing and other purposes. Nothing in this provision shall require or obligate us to send any notice if no notice is required or mandated elsewhere in this Agreement. You may unsubscribe from our marketing communications at any time, although you will continue to receive transactional messages from us.
You agree that we may, but are not obligated to, monitor or record any of your telephone conversations and chat texts with us for quality control purposes, for purposes of training our employees and for our own protection. You further agree that any Authorized Users or anyone else you authorize to use your account consents to such monitoring or recording as well.
By entering into this agreement, you acknowledge that we may contact you via telephone (either by a live person, automatic dialer, prerecorded message or a combination of the foregoing) to discuss our services and you consent to such contact. Further, you consent to receive such phone calls and or text messages at the telephone number you entered on the site. You do not need to agree to this provision in order to use the Site or use our professional services and if you would like us not to contact you by telephone, please send an email to Questions@sweephub.com. Upon request, we may also contact you via telephone (including by automatic dialer or prerecorded message) or text you in order to provide you with your password or other information you request.
